1854 ASHER, Michael, sr. - State of Arkansas, County of Washington, In the Probate Court of said County at the January Term thereof A.D. 1854: Walter Asher, Sarah Asher, Tho's. Asher, Rebecca Asher, adult heirs ofMitchel{sic} Asher, deceased, and John W. Asher and Miller Asher, minor heirs of the said Michael - by their Guardian Walter Asher, and Michael Asher, Elizabeth Asher, John Asher, Elizabeth Asher, William Asher and Mary Asher, minor children and heirs at Law of Michael Asher, jr dec'd, who was a son and heir of Michael Asher sr. dec'd, by Walter Asher their Guardian ....... . And now on this day come said petitioners, and file their petitions for the sale and distribution of certain slaves belonging to the Estate of Michael Asher sr. deceased, and therewith the affidavit of Walter Asher that James R. Asher, in said petition named as being one of the heirs at Law of said Michael Asher sr. deceased, is not a resident of the State of Arkansas: It is therefore on motion of said petitioner's Attorney, ordered by the court here that the petitioners have made application to this court for the sale and distribution of certain slaves to wit: Nice, Phebe, Linn, Violet and Martha, belonging to the estate of the said Michael Asher sr. deceased, that it is alleged in said petition that division of said slaves cannot be made in kind, and that a sale thereof is necessary for the purpose of distribution. And the said James R. Asher is by the court here ordered and required to appear before this court on or before the third day of the next term thereof, at a Probate court to be held at the Court-house in the county of Washington in 1854 the State of Arkansas on the third Monday in April 1854, and shew cause if any he have or can - why such sale and distribution be not made. And it is ordered by the court here that this order be published in the "South-West Independent," a newspaper published in the town of Fayetteville, in the State of Arkansas, for two weeks in succession, the last insertion to be at least six weeks before the said third Monday in April A.D. 1854, and that this cause stand continued.
