Zula died July 16, 1893 and Marshall's wife Roxie died on August 28, 1893 in Wayne County.
Marshall married a second time to Mary E. "Molly" Paine on July 4, 1895 in Huntington, Cabell County, West Virginia. Born to this union:

Marshall Davis Jr.
Marshall moved his family to Oklahoma. From there they settled in Yoncalla, Oregon. Marshall had only been living there about a year when he was killed in a hunting accident. He was deer hunting with Mr. Brumfield, Albert Bacon and Mr. LaFleur. The tragedy occurred in Elkhead Canyon, about ten miles east of Yoncalla on August 6, 1909. Albert Bacon mistakenly shot Marshall while the party was working their way down the canyon. Mr. Bacon admitted he had been reckless. He was acquitted of the accidental shooting. Per daughter Zera, “Daddy’s last words were, ‘Oh Bacon, you shot me’”
Mary buried Marshall in Oregon. She then moved her children back to Huntington, Cabell County, West Virginia. She raised her children, never remarried and remained there until her death.
