Marshall moved the family to Oklahoma. From there they settled in Yoncalla, Oregon. Marshall had only been living there about a year when he was killed in a hunting accident. He was deer hunting with Mr. Brumfield, Albert Bacon and Mr. LaFleur. The tragedy occurred in Elkhead Canyon, about ten miles east of Yoncalla on August 6, 1909. Albert Bacon mistakenly shot Marshall while the party was making their way down the canyon. Mr. Bacon admitted he had been reckless. He was acquitted of the accidental shooting.
